This is the agreement between ABEM and the sellers who use our workshop. It is written to be read, not to be survived. If a clause is unclear, ask us before you rely on your own reading of it.

ABEM is operated by [LEGAL ENTITY NAME], [ENTITY TYPE] registered in [STATE], United States. By creating an account you accept these terms. ABEM is a business-to-business service: you must be at least 18 and acting for a business or professional practice, not as a consumer.
We print, frame, pack, and ship physical goods on your instruction. You sell them; we make them. We are your production partner, not your retailer.
You are the seller of record to your customers. You set your own retail prices, you take the payment, you write the listing, and you own the customer relationship. Parcels ship under your name and carry nothing that advertises ABEM. Correspondingly, your customer's claims are yours to answer; our obligations run to you, not to them.
Keep your login credentials to yourself and tell us promptly if you think someone else has them. Anything done through your account is treated as done by you. Give us accurate information and keep it current. An order we cannot ship because the address was wrong is not a production failure.
You keep every right you have in your artwork. We claim no ownership of it. You grant us a licence to store it, reproduce it, and make derivative renderings of it (mockups, print files, proofs) strictly so that we can produce your orders and show you what you are about to sell. That licence ends when you delete the work or close your account, save for copies we must keep in production and order records.
In return you confirm that you actually hold the rights to what you upload, including any rights in photographs, fonts, logos, and likenesses inside it. We do not check this and cannot: we see a file, not its provenance. If a third party comes after us over artwork you supplied, you agree to cover the resulting claims, damages, and reasonable legal costs.
We may refuse or stop production of anything unlawful, infringing, or that we do not want made in our workshop, including sexual content involving minors, incitement to violence, and hate material. That judgement is ours, and we will refund work not yet produced rather than argue about taste.
These are the honest limits of physical reproduction, and we would rather set them out here than in a complaint thread.
The layout you approve in the editor is what we print. Once you approve it, it is your proof.
Every item is made to order. Production begins shortly after an order reaches us, so a change or cancellation is only possible while the order still shows as new. After that the piece exists and cannot be returned to stock.
Production and shipping times quoted anywhere on this site are estimates, not guarantees. Once a parcel is handed to the carrier, its timing is in the carrier's hands. Risk of loss passes on delivery to the address you gave us.
If an item arrives damaged, misprinted, or not what the approved layout specified, tell us within [CLAIM WINDOW] of delivery with photographs, and we will reprint it or credit you. That is our responsibility and we do not argue about it.
Because every piece is made to order, we do not accept returns for a change of mind, and we cannot remake work for problems that come from the file you supplied or the layout you approved.
[PRICING AND PAYMENT TERMS TO BE COMPLETED: what you charge sellers, when it is charged, accepted methods, what happens on non-payment, and who bears taxes and duties.] What you charge your own customers is your business, and none of ours.
If you connect a sales channel, you authorise us to receive orders and the delivery details attached to them, and to write fulfilment and tracking information back. We act on what the channel sends us. Those platforms have their own terms, we do not control them, and a channel that changes or withdraws its access is not a breach of this agreement by us.
To ship an order we need your customer's name and address. For that data you are the controller and we act on your instructions; we do not market to your customers or use their details for anything but making and delivering the parcel. You confirm you may lawfully pass those details to us. How we handle all of it is set out in our Privacy Policy.
We work to keep ABEM available and accurate, but the platform is provided as it is. We do not warrant uninterrupted access, and we may change, add, or retire features. If we withdraw something you depend on, we will give you reasonable notice.
To the extent the law allows, neither side is liable for lost profits, lost sales, or other indirect losses, and our total liability for any claim is limited to the amount you paid us for the order it relates to. Nothing here limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot be limited by law.
You can close your account whenever you like. We may suspend or close an account that breaches these terms, and will say why unless the law prevents us. Orders already in production are completed and paid for either way. After closure we keep what our records and legal obligations require, as described in the Privacy Policy.
If we change these terms we will update the date at the top and tell account holders about anything material before it takes effect. Continuing to use ABEM after that means you accept the new version.
